Pine Design & Marketing provides structured marketing services, including but not limited to:
Web Design & Development
Brand Identity & Logo Design
Advertising & Lead Generation
Consulting and related services
Project scope, deliverables, timelines, and payment structure will be outlined in written proposals, invoices, or agreements prior to project initiation.
Only services explicitly stated in writing are included in a project.
2. Project-Based Pricing
All projects are structured engagements with defined scope and pricing.
Pricing is based on agreed deliverables — not hourly billing.
Additional requests outside of scope may require a separate agreement or additional fee.
Scope changes must be approved in writing.
3. Payment Terms
Deposits
Projects require a deposit prior to commencement unless otherwise agreed in writing.
Payment Plans
If a payment plan is agreed upon:
Payments must be made according to the agreed schedule.
Failure to complete payment may result in project suspension.
Non-Refundable Payments
Payments, including deposits, are non-refundable unless otherwise stated in writing.
4. Client Responsibilities
Clients agree to:
Provide required content, assets, and feedback in a timely manner.
Communicate clearly during project milestones.
Review deliverables promptly to avoid delays.
Project timelines may be extended if required materials or approvals are delayed.
5. Intellectual Property
Ownership
Upon full payment, final deliverables become the property of the client, unless otherwise stated.
Portfolio Use
Pine Design & Marketing retains the right to display completed work in portfolios, marketing materials, and case studies unless otherwise agreed in writing.
6. Advertising Services Disclaimer
For advertising and lead generation services:
We do not guarantee specific results, revenue, or return on investment.
Performance depends on market conditions, budget, competition, and other external factors.
Clients are responsible for approved ad budgets unless otherwise agreed.
We guarantee structured execution — not specific outcomes.
7. Termination
Either party may terminate services in writing.
If terminated:
Outstanding payments remain due.
Work completed up to termination will be invoiced accordingly.
Access to accounts or deliverables may be suspended until payment is resolved.
8. Limitation of Liability
Pine Design & Marketing is not liable for:
Indirect, incidental, or consequential damages.
Business losses resulting from third-party platforms (e.g., Meta, Google).
Hosting outages, platform suspensions, or external service interruptions.
Total liability shall not exceed the total fees paid for the specific service in question.
9. Governing Law
These Terms are governed by the laws of the State of Michigan, United States.
Any disputes shall be resolved through binding arbitration in [Insert County], Michigan before legal proceedings.
10. Modifications
We reserve the right to modify these Terms at any time. Continued use of our services constitutes acceptance of updated terms.
